In India only the Ministry of External Affairs can issue the Apostille. The Apostille is different then the regular attestation. The Apostille is a Certificate of Authenticity and Genuineness of a document.

What You need :

1. Original Documents
2. Copy of Passport
3. Name of the country for which you need Apostille.

How to do :

The process of Apostille involves two steps; one is the authentication of documents from Issuing states home department. Second step is to submit to the Ministry of External Affairs for Apostille.

Sample Non Availability of Birth Certificate from Warangal AP
The Non Availability of Birth Certificate is a Statement about the availability of Birth Records. It simply states that the issuing authority does not have the Birth Record of that person (See the sample on left)

The Non Availability of Birth Certificate is required mainly for the USA immigration purposes to prove the non-availability of Birth Record. The Non Availability of Birth Certificate does not prove the Date and place of birth or the parentage, so it can not be used as a substitute of Birth Certificate. The Non Availability of Birth Certificate  is not useful to get the passport. The Birth Certificate is needed for that.

In some southern states of India such as Tamil Nadu the Non Availability of Birth Certificate is useful to get the birth registered.

On the other hand the Birth Certificate is best legal document  to prove the date, place of Birth long with the parentage. If anyone has any other document containing the birth details different then Birth Certificate such as 10th class certificate, the Birth Certificate will prevail over all those docs.


Infrastructure Of Indian Immigration

The Indian immigration is a fairly new subject for Indian lawyers to practice. Unlike USA, in India there is no separate court for Indian Immigration. It is very rare to file an appeal against any deportation order issued by Ministry of Home Affairs, India. Because of  lack of a dedicated immigration law enforcing body in India, the Indian Immigration law practice is mostly limited to provide legal advise and preparation of  necessary documents.
